This bail application under Section 439 Cr.P.C. has been moved on behalf of accused-applicant, Rasid, seeking enlargement on bail in Case Crime No. 17 of 2023, under Sections 452, 377, 323, 506 I.P.C. and Section 3/4 of POCSO Act, Police Station Mirzapur, District Saharanpur. Learned counsel for the applicant argued that the accused- applicant is innocent; he has been falsely implicated in this very case crime number and is languishing in jail since 02.02.2023; there are contradiction in the statements of the victim under Section 161 and 164 Cr.P.C.
