Heard Sri Shashi Kant Shukla, learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Sadab, with a prayer to release him on bail in Case Crime No. 547 of 2023, under Sections 302, 323, 34 IPC, Police Station Civil Lines, District- Moradabad, during pendency of trial. There is allegation in the FIR that applicant and informant are residing in the same house. The dispute took place between them on account of sharing of bathroom. In a fit of anger, applicant is alleged to hit on the head of the deceased by wooden patari, which resulted in his death. Learned counsel for the applicant has submitted that this case is at the most of culpable homicide not amounting to murder of the deceased. Implication for committing the all
