This Criminal Appeal has been filed against the judgment and order dated 23.4.1987 passed by learned Additional Sessions Judge-Ist, Aligarh, under Sections 302/34 and 201/34 in Sessions Trial No. 1 of 1984 (State vs. Indra and others) and Sessions Trial No. 18 of 1984. 4. Vide order dated 4.9.2018 appeal was dismissed as abated in respect of appellant No. 2-Ishwari Prasad. 5. As per office report dated 5.11.2020, the lower court record is not available. 6. On 11.11.2024, the following order was passed: "As per the report of the District Judge Aligarh dated 28.37.2024, we have been made aware that the reconstruction of the record of the case is not possible. It is to be examined by the District Judge, Aligarh as to whether a retrial is possible in the matter or not, as p
