Jaiswal, learned counsel for respondent no.1. 2. The case of the petitioners is that they were owners of Khasra no.838 area 0.7330 hectare, Village- Akbarpur, Tehsil and District- Bulandshahr. An area measuring 639 sq. mtrs. was acquired under the provisions of the National Highways Act, 1956. The notification in that regard were issued in the year 2009 and 2010 and an award was made on 21.12.2010. Possession was taken in the year 2011. At the time of taking possession, the respondents took possession of excess area measuring 159 sq. mtrs. and the said fact became evident from survey report dated 2
