The case of the petitioner is that the compensation amount determined under award dated 01.05.2023 under the provisions of the National Highways Act, 1956 in respect of Gata no.805 area 0.0020 hectare, Village- Nevada Kala, Tehsil- Bhadohi, District- Bhadohi is inadequate as the same has been awarded by treating the land to be agricultural whereas according to the petitioner, commercial activities are already going on over the same and, therefore, compensation should have been determined at the rate prescribed for such kind of land. 3. In our considered opinion, in case, the petitioner is aggrieved by inadequacy of the compensation amount awarded by the competent authority, it is open to him to challenge the
