The instant petition has been filed under Article 226 of the Constitution of India with the grievance that NHAI (respondent no. 4) while executing a project relating to construction of a national highway, has taken possession of excess area. It is submitted that according to the acquisition notification, only 960 sq. meters of Plot No. 68 was acquired, while on the spot, NHAI has taken possession of 2,200 sq. meters. In support of the submission, reliance has been placed on a communication sent by competent authority to NHAI dated 5.2.2014, wherein the said fact has been mentioned. The petitioner has prayed for a direction to the respondents not to dispossess him, except in accordance with law. 2.
