The case of the petitioner is that his share in the acquired land and house has been wrongly determined by the competent authority under the provisions of the National Highways Act, 1956. According to the petitioner, the Authority has wrongly shown Keshav and Deepak as having equal shares whereas the petitioner along with Keshav, Deepak and two other have one fifth share each. 2. In paragraph-4 of the writ petition, it is stated that Deepak Kumar had died and is survived by various heirs but who have not been impleaded. Moreover, the dispute relates to apportionment and therefore, the remedy of the petitioner would be under Section 3H(4) of the National Highways Act, 1956. 3.
