Court No. - 49 Case :- WRIT - B No. - 4798 of 2024 Petitioner :- Dharmendra Singh And 4 Others Respondent :- Deputy Director Of Consolidation And 5 Others Counsel for Petitioner :- Ram Chandra Yadav Counsel for Respondent :- C.S.C. Hon'ble J.J. Munir,J. The delay condonation application filed by respondent nos.4 to 6 in aid of their objections under Section 9-A(2) has been allowed vide order dated 06.12.2024. The respondents claim title on the basis of inheritance. The notification under Section 4 of the U.P. Consolidation of Holdings Act, 1953 was issued on 30.01.2021 and objections under Section 9-A(2) of the said Act were filed on 01.03.2021. This marginal delay was condoned by the Consolidation Officer. The petitioner challenged the said order in appeal and then in revision. In a title matter, the endeavor of the Court should always be to lean in favour of hearing on merits and this is what all the three Authorities below had done. We do not find any such manifest illegality in the order impugned as to warrant interference by this Court under Article 226 of the Constitution. This petition fails and is, summarily, dismissed.
