Heard learned counsel for the petitioner, Sri Rajesh Kumar Dubey, in support of the motion to admit this petition to hearing at length and Mr. Ashutosh Kumar Rai, learned Additional Chief Standing Counsel for the State. The petitioner has challenged the order dated 08.07.2024 passed by the Revenue Officer, Madawara, Tehsil-Madawara, District- Lalitpur, by which he has declined an application to demarcate land comprising Plot Nos. 301, 894, 917 and 902 in the exercise of powers under Rule 109 for the purpose of delivering possession. The Consolidation Officer has refused to demarcate for the purpose of delivery of possession in view of the fact that in Writ-B No.1909 of 2022, which arises out of objections under Section 9- A(2), this Court has passed an interim order directing that parties shall not create any third party rights over the property in dispute.
