Brief facts of the case are that village- Atali, Pargana & Tehsil-Budhana, District- Muzaffarnagar came under consolidation operation by way of notification issued on 16.12.1983, under section 4 of U.P. Consolidation of Holdings Act, 1953 (hereinafter referred to as “U.P.C.H. Act”) and till date, consolidation operation has not been concluded in the village in question. Civil Misc. Writ petition No.- 11378 of 1991 (Rajpal Singh vs. state of U.P. & Others) was filed before this Court and consolidation proceedings of the Village- Atali was stayed by this Court.
