By means of the instant writ petition filed under Article 226 of the Constitution of India the petitioner has challenged the validity of the impugned judgment and order dated 26.11.2020 passed by the Armed Forces Tribunal, Lucknow whereby the Original Application filed by the petitioner has been rejected on the ground of being barred by limitation. The petitioner while serving as a Sepoy had submitted a resignation on 04.05.2007 stating that he had already served for nine years & two months and he was unable to serve any more because he was suffering from some problems and he had to look after his ailing wife due to which he was under mental stress. The resignation was accep
