Heard learned counsel for the parties and perused the record. 2. The present petition has been filed by the petitioner with the following prayer: "Issue a writ, order or direction in the nature of MANDAMUS thereby commanding the opp. Parties specially the opp. Party No. 2 to 4 to remove the illegal encroachment of the encroachers i.e. Opp. Party No. 6& 7 from the land gata No. 50/0.134hec. and land gata No. 51ka/ 0.032 hec.. which is recorded as pond in the revenue record situated at village Sisavariya, pargana Tahsil and District Gonda with immediate effect and also take appropriate and strict action against him so that the petitioner could get justice." 3. Learned Standing Counsel based upon instructions states that the proceedings under Section 67 of the U.P. Revenue Code have been initiated against the encroachers including the petitioner.
