It appears that the pathway passes through the private land of one Balley and others who have instituted Civil Suit No. 2636 of 2024 before the court of Civil Judge,(Junior Division), Bahraich where an order of status quo has been granted. Once the judicial proceedings with reference to the disputed land are pending, entertaining the present writ petition in public interest at the instance of a person not aggrieved would be against the judicial propriety. Leaving it open for the petitioner to wait the outcome of the pending proceedings, the writ petition filed in public interest is declined to be entertained and it is accordingly rejected.
