The petition has been filed by the petitioner seeking a direction to cancel the license of fair price shop in favour of respondent No. 7. 2. Submissions have been made that respondent No. 7 has been elected as Member of the Zila Parishad and therefore, he cannot be permitted to continue to operate the fair price shop and therefore, his license be ordered to be cancelled. 3. Learned Government counsel has produced material to indicate that though a Member of the Zila Parishad cannot be allotted a fair price shop, however, in case, a dealer of a fair price shop gets elected as a Member of the Zila Parishad, the same does not lead to cancellation of his license and therefore, the petition deserves dismissal. 4.
