HON'BLE SRI JUSTICE K.SURESH REDDY AND HON'BLE SRI JUSTICE T.C.D.SEKHAR CRIMINAL APPEAL Nos. 219 OF 2022 JUDGMENT: (per Hon'ble Sri Justice K.Suresh Reddy) Since it was brought to the notice of this Court that Ms. Naseeb Afshan, learned counsel appearing for the appellant-accused, passed away, this Court by order dated 06-11-2024 directed the Registry to issue notice to the appellant-accused. Consequently, the Registry sent a notice to the appellant-accused who is undergoing imprisonment in Central Prison, Rajamahendravaram. 2. Today when the matter is taken up for hearing, the Registry has placed the served notice on record, wherein the appellant-accused submitted that he had already preferred Criminal Appeal No. 59 of 2021 through Sri Tagore Yadav Yaragorla, learned counsel, and by mistake, he preferred the present appeal against the very same judgment through Ms. Naseeb Afshan, learned counsel, who passed away recently and therefore requested this Court to withdraw the present criminal appeal. 2 3.
