Heard Sri Ashutosh, learned counsel for the applicant, Sri Shailesh Kumar Srivastava, learned counsel for the informant as well as Sri Jai Kishan Chaurasia, learned State Law Officer for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.438 of 2024, under Sections 137(2), 64(1), 65(1) B.N.S. and 3/4(2) POCSO Act, Police Station- Milak, District- Rampur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by about four days and there is no explanation of the said delay caused. The victim is a consenting party as is but evident from her statement recorded U/s 183 B.N.S.S. The victim by her looks seems to be major, although as per the school certificate of Class-7, her date or birth is stated to be 6.4.20
