This bail application under Section 439 Cr.P.C. has been moved on behalf of accused-applicant, Shivam, seeking enlargement on bail in Case Crime No. 398 of 2022, under Section 354-A of the Indian Penal Code, and Section 7/8 of the POCSO Act, Police Station Ramgarh, District Firozabad. Learned counsel for the applicant submits that as per version of FIR, the victim is about 17 years old. On the day of alleged incident when she was going to school to collect her mark-sheet, in the way the accused applicant along with other co-accused told her to take five hundred rupee note and started making obscene gestures.
