Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 16.11.2024. Learned counsel for the applicant submits that offence under Essential Commodity Act in which the applicant has been falsely implicated is triable by Magistrate and maximum punishment in this case is of one year.
