The instant bail application has been filed on behalf of the applicant, Shadaul, with a prayer to release him on bail in Case Crime No. 139 of 2021, under Sections 302, 452, 323, 504, 506, 34 IPC, Police Station Nehtaur, District- Bijnor, during pendency of trial. This is second bail application of the applicant. The first bail application of the applicant was rejected by this Court on 13.9.2022 directing the trial court to conclude the trial against the applicant as expeditiously as possible, preferably within period of one year. Learned counsel for the applicant has submitted that the applicant is in jail since 17.5.2021. Only four prosecution witnesses out of thirty five have been examined till date.
