This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Asmit, seeking enlargement on bail in Case Crime No. 294 of 2024 , under Sections 109, 3 (5) of the Bharatiya Nyaya Sanhita, 2023, Section 3/25/27 of Arms Act, Police Station Sarsawa , District Saharanpur. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 26.9.2024. Learned counsel for the applicant submits that it is a case of sudden provocation. There is differentiation in the FIR as well as in the statement of injured behind the motive of occurrence.
