Heard learned counsel for the applicant and learned A.G.A. for the State as well as perused the record. The present bail application has been filed by accused-applicant seeking bail in Case Crime No.403 of 2024, under Section 60/63 of Excise Act, Police Station Hari Parwat, District Agra. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 18.10.2024. Learned counsel for the applicant submits that similarly circumstanced co-accused Mohit has already been enlarged on bail by co-ordinate Bench of this Court on 27.11.2024 in Criminal Misc. Bail Application No. 42455 of 2024. He has no criminal antecedent and there is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail.
