The instant bail application has been filed seeking release of the applicant on bail in S.T. No.701 of 2011 arising out of Case Crime No.505 of 2009, under Sections 302, 201 IPC, Police Station Mainather, District Moradabad, during pendency of the trial in the court below. 4. Learned counsel for the applicant submits that neither applicant was named in the FIR nor during investigation his complicity could be revealed and therefore, no charge-sheet was filed against him but during trial on 26.04.2023 i.e. after more than fourteen years, an application was moved by the father of the deceased to summon applicant and others under Section 319 Cr.P.C. and on the application moved by him,
