Applicant seeks bail in Criminal Case No.27599 of 2024, Case Crime No.298 of 2024, under Sections 87, 70, 352 B.N.S., Police Station Kubersthan, District Kushinagar, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is not named in the FIR and has been falsely implicated in the present case. His name has come up later on in the statement of the victim recorded under Section 183 B.N.S.S., whereby she has stated that the applicant had caught her hand and the co-accused person Sagar had committed rape with her.
