Heard Sri Awadhesh Kumar Malviya, learned counsel for the applicant, Sri Sunil Kumar, learned A.G.A. for the State as well as perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 413 of 2024, under Sections 70(1), 351(3) of B.N.S., Police Station Lar, District Deoria, during the pendency of trial. 4. As per prosecution story, the applicant and co-accused person Govind Pal are stated to have gang raped the victim by gagging her mouth with the dupatta on 07.11.2024 at about 10 p.m. when she had gone to ease herself out. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence. It is next stated that the FIR is delayed by about three days and there is no explanation of the said delay caused. The victim, admittedly, is major.
