The instant application has been filed seeking release of the applicant on bail in Case Crime No. 224 of 2024, under Sections 103(1), 3(5) & 61(2) BNS, Police Station Kakor, District Bulandshahar, during pendency of the trial in the court below. 3. Learned counsel for the applicant submitted that nobody was named in the FIR but during investigation on the basis of suspicion with the aid of section 61(2) BNS, applicant has been made accused in the present matter alongwith informant of the case i.e. co-accused Arun and after considering entire facts of the case, co- accused Arun has been released on bail by this Court vide order dated 27.2.2025 passed in Crl. Misc. Bail Application No. 2553 of 2025 and applicant is brother in law of Arun and his case is on better footing than
