A perusal of office report dated 22.02.2025 based on the report of CJM, Bareilly dated 21.01.2025 according to which the sole surviving appellant no. 2 namely Smt. Panna Rani w/o Ved Prakash Rastogi died on 14.11.2024, copy of death certificate along with the statement of Naveen Rastogi and Mukesh Rastogi apart from the other reports have been annexed. Accordingly, the appeal stands abated in respect of appellant no. 2. Therefore, the appeal in respect of appellant no. 1 namely Ved Prakash s/o Prahladi Lal has already been abated vide order dated 19.11.2019 of this Court.
