This appeal is directed against the order dated 18.10.2024 passed by the Commercial Court, Bareilly whereby the petition filed by the appellant under Section 34 of the Arbitration and Conciliation Act, 1996 (for short, 'the Act') has been dismissed. 2. The award was passed by the sole Arbitrator on 19.09.2023 which was amended on 02.12.2023 requiring the appellant to make payment of the claim made by the petitioner to the tune of Rs. 12,57,495/-. The Commercial Court, after considering the plea raised by the appellant pertaining to the validity of the award, came to the conclusion after going through the record that no case for interference was made out in terms of provisions of Section 34 (2) of the Act and, consequently, dismissed the application.
