The present petition has been filed seeking a direction to respondent no.3, the Sub Divisional Magistrate, Tamkuhiraj, District Kushinagar, to decide the Case No.81 of 2012, [Bhola and Others Vs. Badri and Others], under Section 41 of the U.P. Land Revenue Act, 1901, within a stipulated time period. Counsel for the petitioner has referred to the 'order sheet' of the case, a copy whereof has been appended to the writ petition, to point out that although several dates have been fixed, but for some reason or the other, the matter is being adjourned and the delay in disposal of the case is causing undue hardship to the petitioner.
