Learned counsel for the petitioners submitted that petitioners have obtained the land in question through a sale deed dated 01.06.2011 based upon that they have filed application for mutation under Section 34/35 before Tehsildar, Chandpur, which was allowed vide order dated 02.05.2013. Against the said order, respondent no. 3 has filed appeal before Sub Divisional Officer, Chandpur and same was allowed vide order dated 30.08.2016 and matter was restored. Case was reheard and decided in favour of petitioners on 17.11.2023.
