The instant petition has been filed for the following relief: "issue a writ order or direction in the nature of mandamus commanding or directing the respondent no.2 to decide the case no.204 of 2014 (Santoo and others vs. Kalawati and others) under Section 12 of U.P.C.H. Act, Kauwasar Tappa Naugawa Pargana Sidhua Jobna Tahsil- Padrauna, District- Kushinagar." 3. Learned counsel for the petitioner submitted that the proceeding under Section 12 of U.P.C.H. Act is pending before Consolidation Officer in pursuance of the order dated 10.9.2014 passed by Settlement Officer of Consolidation by which matter was remanded back before the Consolidation Officer after setting aside the order dated 1.8.1992 passed by Assistant Consolidation Officer.
