The grievance of the writ petitioner is that though he was appointed on the post of Home Guard and he worked from Home Guard, however, owing to pendency of a Criminal Case No. 344 of 2019 under Section 304B, 498A IPC, the writ petitioner has been issued show cause notice why his services has not been dispensed with. He seeks to rely upon the decision of this Court in Mahesh Singh Vs. State of U.P.: Writ A No. 16186 of 2024 decided on 26.09.2025 so as to contend that the provisions contained under clause 5 and 6 have been rendered ultra vires.
