The case of the writ petitioner is that he was appointed in the Forest Department in daily wage basis, however, the writ petitioner superannuated on 31.12.2022. The writ petitioner claims to have been paid minimum of the pay scale but had not been accorded benefits of pension. He seeks to rely upon the decision of Hon'ble Apex Court in Prem Singh Vs. State of U.P. : (2019) 10 SCC 516 as well as the order of the Coordinate Bench in Writ-A No. 6959 of 2022 decided on 07.05.2022. 3. Learned Standing Counsel submits that the claim of the writ petitioner needs adjudication at the first instance by respondent no. 3, Divisional Forest Officer, Division Pilibhit, District Pilibhit. 4.
