The case of the writ petitioner is that he was appointed as a Medical Officer in the year 1985 and he superannuated as Chief Medical Superintendent at Zila Mahila Chikitsalaya, Mirzapur on 31.10.2009. According to the writ petitioner, the writ petitioner is not being paid the post-retiral benefits as per the admissibility which stood accrued on the last pay drawn, when he stood retired. Though the writ petitioner had preferred several representations, but nothing has been done. Submission of the learned counsel for the writ petitioner is that there is no departmental proceeding pending against the writ petitioner on the even of the retirement and further there was a controversy relating to acceptance of voluntary retirement, however, the same would not dilute effect o
