The case of the writ petitioner is that the husband of the writ petitioner, Late Abir Ali was married with one Smt. Hamidan (Respondent no.6) on 14.07.1964 according to Muslim rites and rituals, and thereafter the husband of the writ petitioner was appointed as Police Constable and thereafter the husband of the writ petitioner took mutual divorce on 04.04.1980 and the writ petitioner's marriage stood solemnized with late Abir Ali on 10.12.1982 and the husband the writ petitioner retired on 31.08.2015 and died on 26.01.2021 and though the writ petitioner had been paid pension, however, on 25.09.2025, the S.P. Banda had issued a notice requiring the writ petitioner to refund the family pension, which he had already obtained. 3. Learned counsel
