Shukla, learned counsel for the writ petitioner and Sri Gaurav Singh, learned Standing Counsel for the State. 2. The grievance of the writ petitioner is that pursuant to an Advertisement dated 23.12.2023, the writ petitioner applied for the post of Constable (Civil Police). The writ petitioner cleared the written and medical examination, however, at the stage of joining and training, a ground has been taken that the FIR bearing No.0001 had been lodged against the writ petitioner under Sections 380, 354 of IPC. Learned counsel for the writ petitioner submits that twice final report has been submitted and his case is to be considered as per the law laid down in Avatar Singh vs. Union of India (2016) 8 SCC 471, as well as in Civil Appeal No.5902 of 2012, Ravindra Kumar vs. State of U.P. decided on 22.02.2024. 3.
