Heard Shri Yash Pratap Singh, learned counsel for the writ petitioner as well as Shri V.K. Srivastava, learned Standing Counsel for the State. 2. A joint statement has been made by learned counsel for the parties that they do not propose to file any affidavit and the writ petition be decided on the basis of documents available on record. 3. With the consent of the parties, the writ petition is being decided as a fresh case. 4. The case of the writ petitioner is that in the year 2000, an advertisement was published on 22.12.2000, for the post of Junior Engineer (Civil) in the Department of Irrigation. The petitioner claims to have been selected, but his joining was deferred as the matter was the subject of a challenge before this Court, which eventually came to be decided by the Hon'ble Apex Court on 15.12.2010 in Civil Appeal No. 4360 of 2010 (U.P.
