This is yet another case in which, despite the Medical Board proceedings clearly certifying that the ailment from which the petitioner suffers, i.e., Recurring Depressive Psychosis, is aggravated by the stress and strain of service, with percentage of disability assessed at 73%, the petitioner is having to litigate before the Court for disability pension. 2. The entitlement of the petitioner to disability pension flows from Rule 4(2)(b) of Central Civil Services (Extraordinary Pension) Rules, 2023, which grants the right to disability pension if the disability or ailment is attributed to or aggravated by service. 3. In view of the findings of the Medical Board, the petitioner is entitled to disability pension. 4. Accordingly, the writ petition is allowed
