This appeal was filed by the State under Chapter VIII Rule 5 of the Allahabad High Court Rules, 1952 on 9.12.2005 challenging the judgement and order dated 3.11.2004 passed by the writ Court in Writ Petition No. 6967 (S/S) of 1997. 3. The limitation for filing special appeal under Chapter VIII Rule 5 of the Allahabad High Court Rules, 1952 is 30 days vide Chapter IX Rule 10 of the Rules, 1952 read with Article 117 of the Schedule appended to the Limitation Act, 1963. The appeal had been filed with a delay of 1 year and 5 days as on 8.12.2005. 4. We have gone through the affidavit in support of the application for condonation of delay and do not find sufficient and satisfactory explanation to condone the delay in filing the appeal.
