Learned counsel for the respondents does not have objection if the application is allowed. 3. We also found that delay has been sufficiently explained, hence, the delay is condoned. 4. The Delay Condonation Application is accordingly, allowed. Order on Special Appeal 1. The appellant/petitioner was promoted in Class-III post in the year 2013. He retired in 2021. Four years after his retirement and 12 years after his promotion to Class III post, he filed Writ-A No.12877 of 2024 (Amar singh Vs. State of U.P. and 4 others) praying that he should be treated as promoted on Class III post with effect from the date of completion of five-year-service on Class IV post in terms of Government Order dated 03.
