Heard Sri Rakesh Kumar Singh, the learned counsel for the petitioner, Sri Pankaj Srivastava, the learned Standing Counsel appearing on behalf of the State, Sri Mohan Singh, the learned counsel for the Gaon Sabha and perused the records. 2. By means of the instant petition filed in the nature of public interest litigation the petitioner has sought a direction for removal of encroachment from the land bearing Gata No.124, measuring 0.0910 hectare, situate in Village Sakhupara, Pargana Haweli Awadh, Tehsil Sohawal, District Ayodhya, which is recorded as chakroad. 3. On the basis of instructions provided to the learned Standing Counsel he has submitted that an order under Section 67 of U.P. Revenue Code was passed for removal of encroachment and presently an application for setting aside an ex-parte order is pending consideration
