This appeal is directed against the order dated 03.10.2022 passed by Commercial Court, Agra in Commercial Suit No. 02 of 2022, whereby application, filed by the appellant under Order XXXIX Rules 1 and 2, C.P.C. has been dismissed. 2. Counsel for the respondents points out that during the pendency of the present appeal and before notices were ordered to be issued by this Court on 27.01.2023, while granting interim order, on 24.01.2023 itself, the plaint filed by the appellant had been rejected, against which appeal is pending. 3.
