The present bail application under Section 483 BNSS has been filed with a prayer to enlarge the applicant on bail in Case Crime No. 164 of 2024, under Sections 323, 366, 376D IPC, Police Station Allahganj, District Shahjahanpur during the pendency of trial. 4. Counsel for the applicant submits that the applicant has been falsely implicated in the present case. The incident is alleged to have occurred on 08.05.2024. The first information report was lodged on 13.05.2024. The delay is fatal to the prosecution case. The victim was admitted in the hospital on 09.05.2024 by the applicant.
