Learned counsel for the applicant has contended that the allegation as levelled in the F.I.R. is that the applicant called the victim at her house and committed rape upon her. Learned counsel next argued that the victim is major. Learned counsel further argued that the victim in her statement recorded under Section 183 of B.N.S.S, has stated that she loves the applicant and is well known to him for the last six years but on 01.07.2025 the applicant had called her, at his house and forcibly raped her. Learned counsel has drawn attention of this Court to the medical report of the victim dated 02.07.2025 and argued that the hymen is old torn healed. Apart from the same, learned counsel has also drawn at attention of this Court to the supplementary medical report, wherein no dead or alive
