Heard Sri Subham Singh, learned counsel for the applicant as well as Ms. Ifrah Islam, learned State Law Officer for the State and perused the record. 3. Applicant seeks bail in Case Crime No.26 of 2015, under Sections 302, 34 I.P.C., Police Station Nai Mandi, District Muzaffarnagar, during the pendency of trial. 4. It is submitted by learned counsel for the applicant that similarly placed co-accused person, Neeraj @ Monu Gurjar has already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 30.11.2016 passed in Criminal Misc. Bail Application No.41769 of 2016. The applicant is languishing in jail since 19.3.2016, having no criminal history. He further submitted that since the role of the applicant is identical to that of co- accused, who has already been enlarged on bail, he is also entitled to be enlarged on bail on the ground of parity. 5
