The present bail application under Section 483 BNSS has been filed on behalf of applicant, Nasir, with a prayer to release him on bail in Case Crime No. 142 of 2024, under Section 8,20,20 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Babri, District- Shamli, during the pendency of the trial. Learned counsel for the applicant has contended that 7.550 Kilogram Charas is alleged to have been recovered from the possession of the co- accused. In fact no such recovery was effected from the applicant. Learned counsel for the applicant submits that neither the applicant was named in the First Information Report nor he has been arrested on spot.
