The present bail application has been filed with a prayer to enlarge the applicant on bail in Case Crime No. 147 of 2025, under Sections 137(2), 87, 64(1) B.N.S., and 3/4 POCSO Act, Police Station- Hazrat Nagar Garhi, District- Sambhal during pendency of the trial. 3. Counsel for the applicant submits that the applicant has been falsely implicated in the present case. The incident is alleged to have occurred on 27.8.2025. The first information report was lodged on 29.8.2025. The delay in lodging the first information report is fatal to the prosecution case. As per the first information report, the victim was aged 18 years. According to the high school certificate the victim was aged 17 year 11 months 7 days at the time of the alleged incident.
