This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused-applicants, Prempal and Hemant, seeking enlargement on bail in Case Crime No. 703 of 2024, under Sections 74, 296, 115 (2), 131 of the Bharatiya Nyaya Sanhita, 2023 and Section 7/8 of POCSO Act, Police Station Banna Devi, District Aligarh, during the pendency of the trial before the Court below. Learned counsel for the applicants argued that the accused-applicants are innocent. They have been falsely implicated in this very case crime number and are languishing in jail since 13.10.2025. Learned counsel for the applicants submits that FIR was lodged on 23.9.2024 and applicants were put behind the bar on 13.10.2025, i.e.
