Learned counsel for the applicant has contended that the allegation of rape has been levelled against the applicant. Learned counsel has contended that the victim in her statement recorded under Section 183 of B.N.S.S., has stated that she had gone with the applicant out of her own free will and concerned but there is no allegation of rape against the applicant. Learned counsel has also drawn attention of this Court to the medical report of the victim, wherein the hymen is found intact and therefore, no offence
