Learned counsel for the applicant has contended that the victim in her statement recorded under Section 183 of B.N.S.S., has specifically in the question answer that the applicant has not committed rape, whereas the allegation of rape has been levelled against the co-accused Wakeel. It is thus contended that the case of the applicant is distinguishable from the case of co-accused Wakeel and that the applicant has been falsely implicated in the present case. It is thus contended that the applicant is entitled for bail.
