The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Nikhil Jaiswal with a prayer to release him on bail in Case Crime No. 257 of 2025, under Section 8/20 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Aurai, District- Bhadohi. Learned counsel for the applicant has contended that total recovery of contraband in this case is of 26Kg 885 grams of Ganja, but as per own admission of prosecution, from the bag carried by the applicant, only 13 Kg 950 grams of Ganja is alleged to have been recovered from the possession of the applicant, which is below commercial quantity.
